Regulations for making donations to the John Paul II and Primate Wyszyński Museum

I. Introductory provisions
1. These regulations, hereinafter referred to as the "Regulations", specify the rules for making cash donations to the John Paul II and Primate Wyszyński Museum with its registered office in Warsaw, ul. Prymasa Augusta Hlonda 1, 02-972 Warsaw, correspondence address: al. Rzeczpospolitej 1, 02-972 Warsaw, entered into the register of cultural institutions maintained by the Minister of Culture and National Heritage under the number RIK 96/2016, NIP 9512414063 and REGON 364481345, (hereinafter referred to as the "Museum") for the statutory activities of the Museum. 2. The terms used in the Regulations mean:
a) the Museum's website - the website available at https://sklep.mt514.pl together with all its functionalities,
b) Donation - funds transferred by the Donor to the Museum, intended for the implementation of the Museum's statutory activities,
c) Donor - any natural or legal person who has transferred the Donation,
d) Payment Operator - PayU SA with its registered office in Poznań, ul. Grunwaldzka 186, 60-166 Poznań, NIP 7792308495, REGON 300523444, KRS 0000274399.
3. Donations support the Museum's statutory activities, including cultural, scientific and educational activities. According to the statute, the Museum's tasks include, among others: conducting cultural, scientific and educational activities in the field of Polish history and the Catholic Church in the 20th and 21st centuries, with particular emphasis on the figures of John Paul II and Primate Stefan Cardinal Wyszyński.
4. Donations are non-refundable.
5. By making a Donation, I accept the Regulations.

II. Rules for making donations on the website
1. The Donor declares that he or she understands the legal nature of the Donation in accordance with Article 888 and Article 890 of the Civil Code.
2. The Donation is a one-time donation, and its amount depends on the decision of the donor.
3. Donations to the Museum can be made in the following ways:
1) by transfer to the Museum's bank account: 37113010170080082318200007, maintained by Bank Gospodarstwa Krajowego, SWIFT: GOSKPLPW with the note "Donation for statutory purposes of the Museum of John Paul II and Primate Wyszyński",
2) via the electronic payment system operated by the Payment Operator, PayU SA, with its registered office in Poznań, ul. Grunwaldzka 186, 60-166 Poznań, NIP 7792308495, REGON 300523444, KRS 0000274399.
4. Donations can be made by clicking "Donations" or when purchasing tickets/goods on the website https://sklep.mt514.pl. After clicking the link, follow the instructions on the payment operator's website.
5. Donations made on the https://sklep.mt514.pl website are made through a payment operator.
6. Transactions made in the PayU system have the necessary security, certificates and safeguards and are made in accordance with the terms specified by PayU S.A. Donors' payments are protected by a secure SSL certificate. Thanks to it, all information sent is encrypted.
7. The security of payments made to the bank account is the responsibility of the banks or financial institutions maintaining the bank accounts between which the transfer is made.
8. When making a donation, the Donor may choose one of the amounts suggested on the https://sklep.mt514.pl website or enter any amount of their choice in the "Other" field.

III. Complaints, complaints about PayU services
1. In the event of problems with making a one-time donation, they should be reported to the Museum at: sprzedaz@mt514.pl.
2. The Donor may file a complaint if the Services provided for in the payment operator's regulations have not been performed or are performed contrary to its provisions. The complaint may be filed in the following form:
a) in writing to the address of PayU S.A., ul. Grunwaldzka 186, 60-166 Poznań
b) electronically via the form https://www.payu.pl/pomoc) by phone at the following number: + 48 61 628 45 05 (call charged according to the operator's tariff, whose services the Donor uses), from Monday to Friday from 8:00 to 20:00.

IV. Personal Data Protection
1. In accordance with art. 13 sec. 1 and 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ EU L 119 of 04.05.2016, p. 1, as amended), hereinafter referred to as "GDPR", the Museum informs the Donor that:
1) The personal data controller is Mt 5,14 | Museum of John Paul II and Primate Wyszyński with its registered office in Warsaw, ul. Prymasa Augusta Hlonda 1, 02-972 Warsaw, correspondence address: al. Rzeczypospolitej 1, 02-972 Warsaw, entered into the register of cultural institutions maintained by the Minister of Culture and National Heritage under the number RIK 96/2016, NIP 9512414063 and REGON 364481345;
2) The Museum has appointed a data protection inspector, who can be contacted in all matters concerning the processing of personal data and the exercise of rights related to data processing via e-mail: Inspektor.rodo@mt514.pl or in writing to the registered office address indicated above;
3) The Administrator processes the data of persons who have voluntarily provided their data: first name, last name, contact details;
4) Personal data will be processed for the purpose of:
a) pursuant to Art. 6 sec. 1 lit. c) and f) of the GDPR in order to settle the donation and pursue any claims arising from the donation, and also – in the event of such consent by the Donor, to the extent including the first name and last name – in order to include the first name and last name of the Donor in the Book of Donors and on the Museum's website, pursuant to Art. 6 sec. 1 letter a of the GDPR),
b) fulfil legal obligations, in particular the obligation to conduct financial reporting (the basis for processing is Art. 6 sec. 1 letter c) of the GDPR),
c) fulfilment of the legitimate interest of the administrator (the basis for processing is Art. 6 sec. 1 letter f) of the GDPR), which should be understood as:
i. answers to questions sent by Donors via e-mail and by phone,
ii. establishing, pursuing or defending claims related to making the Donation;
5) Personal data will be processed until:
a) the limitation period for any claims arising from the donation agreement expires,
b) in relation to data processed within the legitimate interest of the Administrator, until the Ordering Party files a justified objection, subject to the next point,
c) until the obligation to store data resulting from legal regulations expires, in particular the obligation to store accounting documents regarding the donation agreement;
6) Personal data may be made available to:
a) state authorities and other entities authorized to access data to the extent and for the purpose specified in legal regulations;
b) external entities providing services to the Administrator supporting its functioning in the scope of services provided, including IT service providers, entities auditing its activities, entities responsible for electronic payments, law firms. 7) In connection with the processing of personal data, in cases provided for by law, the Ordering Party using the service has the following rights:
a) access to their personal data,
b) rectification of their personal data,
c) deletion of their personal data,
d) restriction of the processing of their personal data,
e) transfer of their personal data,
f) objection to the processing of their personal data,
g) withdrawal of consent to the processing of personal data in a situation where it constitutes the basis for data processing, which, however, does not affect the lawfulness of the processing carried out on the basis of consent before its withdrawal,
h) lodging a complaint with the supervisory authority, i.e. the President of the Personal Data Protection Office - more information on this right is available at: https://eur-lex.europa.eu/legal-content/PL/TXT/?uri=CELEX%3A32016R0679;
8) Providing personal data by the Donor is voluntary, but necessary for its implementation;
9) The personal data of Donors will not be transferred to countries outside the European Economic Area;
10) The Administrator will not conduct activities involving automated processing (including profiling) of the personal data of Donors, which could have legal effects on Donors or otherwise significantly affect them.
2. Data provided during the payment process during communication with the bank is processed by the given bank on the principles specified in the privacy policy of the given bank and is not made available to the Museum.

V. FINAL PROVISIONS
1. The Museum is entitled to change these Regulations at any time.
2. The Regulations and their amendments are subject to publication on the Museum's website.
3. The Regulations are effective from the date of their announcement on the Museum's website.
4. Each interested person
